FLSA Status Questionnaire

The Fair Labor Standards Act (FLSA) is a federal law administered by the Department of Labor, Wage and Hour Division. IU HR Compensation ensures compliance with the FLSA by providing training, guidance, support, and administrative oversight. Management and local HR representatives also have responsibility for ensuring labor law compliance, including the FLSA. Any fines or penalties associated with non-compliance with the FLSA will be the responsibility of the department/school/RC. The following considerations and questions will help inform the appropriate FLSA status (exempt or non-exempt) for new position requests and career progression reviews. If unsure how to answer or respond, please attempt to complete as many fields as possible, as this information will still be valuable for consultation and documentation of the position. You can also reach to with specific questions, and a Compensation team member will provide guidance.

How to use this form:

  1. Consider the position’s duties and answer each question accordingly. Fields requesting additional explanations may appear when you make certain selections.
  2. When completed, click the "Email the Form" button at the bottom.
  3. Note that an email will only be sent to the address entered in the “Submitter's Information” section of this form; it will not be routed to the Compensation team. The email will contain the contents of the form and can be copied and pasted into a Word document for further editing and saving.
